In September 2014 the new SEN Code of Practice came into force. The Children and Families Act 2014 represents a transformation in the way support is provided for children and young people with SEND up to the age of 25.
The new SEND legislation will bring changes to the way statements, reviews and services will be delivered and publicised and should be more accessible and family centred than ever before.
In school there will be a single SEN stage called ‘SEN Support’ this replaces the current system of School Action and School Action Plus, and there will be more emphasis on teacher support, rather than ‘Teacher Assistant’, (in BFS we call this role a Learning Mentor, LM), support in lessons with LMs taking on a slightly different role. The school SEN register will be reviewed to make sure that a graduated response is in place for learners with SEN and those students who are underachieving are not incorrectly assumed to have SEN and placed on the register.
The current Statement that is issued after Statutory Assessment will be replaced by an Education, Health and Care Plan (EHC Plan). All students who currently have a statement will transition across to an EHC plan over the next 4 years. During this transition time, both the statement and the EHCP will have equal statutory rights so no student with either one will be disadvantaged.
